AI translation is already inside your vendor’s workflow. The question is whether anyone is reviewing it.
This is not a hypothetical. In 2024, a major Midwestern hospital system discovered that a contracted language services vendor had been using consumer-grade AI translation tools to fulfill medical document requests without disclosing it. The translated patient consent forms passed a surface review. A clinical pharmacist caught a terminology error during a medication counseling session. The error had been present in 47 documents delivered over four months.
That situation is not an outlier. It is an early example of a problem that is spreading as AI translation tools become cheaper, faster, and more embedded in vendor operations, often without the buyer’s knowledge or consent.
For procurement, compliance, and operations leaders in healthcare, government, and life sciences, the governance question has shifted. It is no longer “are we using AI translation?” It is “do we know where it is being used, and what is reviewing the output?”
The Governance Gap That Most Buyers Are Not Managing
Enterprise buyers tend to evaluate translation vendors on quality, turnaround, and price. What most RFP processes do not ask is: when AI translation is used in our deliverables, who reviews it, how, and under what documented standard?
The answer, at most language service providers, is: it depends. AI tools are used selectively, the extent of post-editing varies by project and by staff, and there is no independent audit of the output. Some vendors disclose AI usage in their process documentation. Many do not.
In a consumer context, this is an inconvenience. In a regulated context, it is a liability exposure. A translated document that produces a patient safety incident, a Title VI compliance failure, or an FDA labeling rejection is not mitigated by the fact that the buyer did not know AI was involved. It is compounded by it.
The compliance defense “we used a certified translation vendor” fails the moment a regulator asks what that vendor’s AI translation review process was, and the vendor cannot produce documentation. Auditability is the issue, not the technology itself.
Where AI Translation Fails in Regulated Contexts
AI translation failures in regulated industries are not random. They cluster in predictable categories that experienced compliance teams can anticipate and test for.
Clinical and technical terminology drift is the most documented failure mode. AI models trained on general-purpose text perform poorly on specialized vocabularies. Medical device instructions, pharmaceutical labeling, and clinical trial consent forms contain terminology that exists in narrow, highly defined contexts. A model that handles “dosage” correctly in a consumer health article may render it ambiguously in a Class II device IFU, where the distinction between “dose” and “dosing interval” carries regulatory significance.
Regulatory language nuance is a related but distinct problem. FDA and EMA labeling requirements are precise not just in terminology but in syntactic structure. Certain legal and regulatory formulations must be reproduced with near-literal accuracy in translation. AI models optimize for fluency, not for regulatory fidelity. A translation that reads naturally in the target language may not satisfy the precision standard the source document was written to meet.
Cultural and contextual adaptation failures are most visible in government communications. A document that is technically translated from English to Spanish may still fail to communicate meaningfully with a Spanish-speaking population whose cultural context differs significantly from the model’s training data. For Limited English Proficiency (LEP) communities receiving government health or benefits information, a technically accurate translation that does not land culturally is functionally inaccessible.
Data security exposure from unsanctioned AI tool use is a newer but fast-growing risk category. When a vendor’s staff, or the vendor’s subcontractors, use consumer-grade AI tools to translate documents containing protected health information, personally identifiable information, or proprietary data, that data leaves the organization’s security perimeter entirely. HIPAA, GDPR, and most enterprise data processing agreements prohibit this. The buyer bears downstream liability regardless of whether the vendor disclosed the practice.
ISO 27001 (Information Security Management) certification is the only independent verification that a language services vendor has implemented documented controls over how client data is handled in its translation workflow, including AI tools.
What a Wrong Translation Actually Costs
The downstream consequences of AI translation failure are not uniform across verticals. Procurement teams evaluating vendors for multiple business units should understand the specific exposure each vertical creates.

Regulators in each vertical are increasingly attaching liability to the buyer, not just the vendor. The Washington State executive order on AI (EO 24-01, signed by Governor Inslee on January 30, 2024 and confirmed as the operative state agency framework) establishes a risk analysis framework for AI use in state agency operations that explicitly covers AI tools used in service delivery to constituents, including language services. Government agencies operating under this framework face compliance obligations that extend to their vendors’ AI tool usage, whether or not those agencies are directly using AI themselves.
The Governance Principle: Human in the Loop
The core governance requirement for regulated AI translation is not avoiding AI. It is ensuring that qualified human review is applied to all AI-assisted output before it is delivered to any context where an error carries a compliance or safety consequence.
This principle has a name in the translation industry: machine translation post-editing (MTPE). It has an ISO standard: ISO 18587. And it has a problem: very few language service providers hold certification to it.
ISO 18587 (Processes for Machine Translation Post-Editing) establishes documented requirements for the post-editing process that validates AI translation output against human-quality standards. Certification to ISO 18587 means that an independent accredited body has audited the vendor’s MTPE process and verified that it meets the standard’s requirements for qualified post-editors, documented review procedures, and quality outcome measurement.
Without ISO 18587 certification, a vendor may still perform post-editing. The question is whether the buyer has any independent verification that the process is consistent, qualified, and auditable. In most cases, the answer is no.
ISO 18587 is one of five ISO certifications Dynamic Language holds. The others are ISO 9001 (Quality Management), ISO 17100 (Translation Services), ISO 27001 (Information Security Management), and ISO 13485 (Medical Devices Quality Management System). This combination is rare at any scale in the language services industry.
What a Managed AI Translation Process Looks Like, and What to Require of Your Vendor
A managed AI translation process in a regulated context has four elements that buyers should be able to verify, in writing, before signing a contract.
Disclosure. The vendor discloses when AI translation is used in any deliverable and specifies which tools are used. This is table stakes. If a vendor does not offer transparent disclosure, the buyer cannot audit anything that follows.
Qualified post-editing. Every AI-translated deliverable is reviewed by a human post-editor with documented subject-matter qualifications for the content type. A general-purpose post-editor is not appropriate for clinical or regulatory content. The post-editor’s qualifications should be documentable on request.
ISO-certified quality process. The post-editing process is certified to ISO 18587. If the vendor does not hold this certification, the buyer should ask what alternative independent verification exists for the quality of the post-editing process. In the absence of certification, the honest answer is usually “none.”
Data security. The vendor’s AI tool usage is governed by its ISO 27001-certified information security management system. Client data does not transit consumer-grade AI tools. The vendor can produce documentation of which tools are used, under what security controls, and how client data is protected within those tools.
Buyers operating in regulated industries should also examine their own internal policies. As AI translation tools become more accessible, staff in procurement, communications, and operations may use them to translate documents without engaging the organization’s language services vendor at all. A responsible AI use policy that covers staff tool usage, disclosure obligations, and the categories of content that require certified vendor review protects the organization from internal exposure as well as vendor exposure.
Seven Questions to Ask Your Translation Vendor Now
If your organization uses a language services vendor for regulated content, these questions should be answered before the next contract renewal, and before the next audit.
- Does your vendor disclose when AI translation is used in your deliverables, and can it identify which tools were used?
- Does your vendor hold ISO 18587 (Processes for Machine Translation Post-Editing) certification, verified by an accredited third party?
- Can your vendor document the post-editing process applied to AI-assisted output, including the qualifications of the post-editor?
- Has your vendor’s AI translation workflow been independently audited within the last 12 months?
- What is your vendor’s remediation process when an AI translation error is identified after delivery?
- Does your vendor hold ISO 27001 (Information Security Management) certification, and can it document that client data does not transit unsanctioned AI tools?
- Does your vendor have a written responsible AI use policy that specifies which tools are approved, under what conditions, and how client data is protected within those tools?
If your current vendor cannot answer these questions clearly, that gap itself is the finding.
A Practical Next Step
The seven questions above are a starting point, not a complete vendor evaluation framework. Each one opens a deeper conversation about how a vendor handles AI translation in regulated contexts: which tools they use, who reviews the output, how the process is documented, and what happens when something goes wrong.
